Kandi Burruss Sues Kim Z Over Tardy For The Party

Kandi Burruss is suing her Kim Zolciak over Tardy For The Party for copyright infringement. Here’s the short of it: Kandi wrote Tardy For The Party for Kim Z. Then, without her consent, Kim commercially released it as a single. The court docs state, “Defendants marketed and sold the Infringing Single in various formats (e.g., compact disc, downloadable audio track, DVD, etc) and through various websites, all without Plaintiffs’ license, consent or authorization.”

Kandi wrote this in an old Bravo blog post in 2010, “I hardly got anything from Tardy for the Party. That is the truth. I am not mad about it. I really blame myself because I didn’t handle my business correctly.”

 Kandi wants accurate accounting of the money, punitive damages, attorney fees, and a jury trial. Get it! 

Want to know who’s repping her case? Phaedra Parks! Don’t you secretly love it? Sh*t just got real!!! I’m all for Kandi getting her money, but part of me thinks she did this all for a Housewives storyline, plus the PR will only help her new show…but whatevs, it’s good TV!

    Suing for credit for “Tardy for the Party” is like suing to establish paternity over some serial killer.

    I thought one of Kim’s daughter music teachers wrote Tardy as a country song and then gave it to Kim. Kandi reworked it as pop, but she didn’t write it, did she?

    @mimo I thought the same thing, and having an internet connection and nothing resembling a life I went online and here’s what I found out. The daughter’s music teacher did write the song, and is the only person listed on the copyright for the song. however, Candy has submitted a photocopy of an agreement signed by Kim, the music teacher, and Kandi where Kandi gets 33% of the rights to the song. I’m just wondering what Kim did lately to piss Kandi off that she would send Phaedara ace attorney/mortician to go get her money. You know, if there are any group of people who need to be standing in front of Judge Judy, these are the ones!

    She should have done this a long time ago. I don’t think Kandi would do it for a storyline; maybe because Kim “stole” her baby name. I think stealing the name “Kash” is more of a favor to Kandi, though. Yikes. Be thankful your potential future child dodged that bullet, girl.

    Isn’t it the theme song of Kim’s new spin-off show? If so, there’s some money to be made there. Kandi isn’t stupid, because Blavo is going to have to cough up some $$$ to use it. After all the shit-talkin’ Kim did after she left after she left the show about her ‘good friend’ Kandi (whom she stiffed for her portion of the proceeds from the song)–about time Kandi sued her.

    I think poster AuroraB got it in one. If this WASN’T some story line cooked up by Andy and Co., Kandi would have sued a long time ago, and she would have gotten a real lawyer. Not a night-school attorney who specialized in getting hip-hop punks out of probation violations. And whose sole purpose for existence is to abuse use of the word “booty”.

    Business is business, and I think it’s a case of absence making the heart go… OFF. Kandi was trying to keep the peace with her ‘friend’ while not having it look like she let someone rip her off. So she said she was choosing to let it go. Now that Kim is off RHOA, seemingly living the high life and saying none of them were ever her friends, Kandi’s going to get hers. (At least I hope so.) Otherwise, she’ll have some snot nosed kid trying to pull the same thing and asking why she’s coming after THEM.

    But Phaedra is actually a real lawyer. She’s taken on a few things for the show but she was already very well known before the show in the Atlanta area as a “super lawyer”. But I agree that this was cooked up as a bravo story line b/c I am sure Kandi already had another lawyer on retainer.

    Im glad Kandi is finally suing that ungrateful blonde golddigger. But there are a couple of holes in her suit. From what I’ve read, the statue of limitations for copyright infringement is three years. Which has long past. And also, didnt the two do a couple of singing gigs together where Kim sang that song? At some gay shindig, didnt Kandi even hype the crowd for Kim just before Kim sang TARDY. Isn’t that implied consent? Should be interesting.

    Also, does anyone know anything about Phaedra getting a Judge Judy-like spinoff? WTF?
